The Microsoft CaseIn the late 1990s,the U.S Department of Jus-tice(DOJ)launched an antitrust
investigation against.Several states joined in the probe,and a European antitrust challenge was still ongoing in 2002.A federal district court judge found Microsoft to be in violation of antitrust laws.An appellate court upheld that opinion and the U.S.Supreme court refused to rehear the case.It was unambiguous that Microsoft had violated U.S .antitrust laws.In 2001,the DOJ and most of the states reached a settlement on remedies to the antitrust violations.The settlement was controversial,in part because professional staffers at the DOJto many,the settlement was a political,rather than an economic decision.
Tim bresnahan,who served as the chief economist for the DOJ during the Microsoft investigation,was especially troubled by the settlement.Bresnahan argued that incumbent standards are very difficult to replace,even if they represent inferior technology.Under some circumstances,however,enough consumers may gravitate toward another standard so as to threaten the incumbent.To make this happen,the market needs to demonstrate divided tecbnical leadership(DTL).When there is DLT,different firms excel in different layers of the vertical chain of complementary products.In the PC marker in the late 1990s,Microsoft excelled in operating systems,but Netscape excelled in web browsing.In Bresnahan's opinion,DLT provides a competitive threat in each layer of the vertical chain.If a firm that dominates one layer does not deliver value to consumers,the firm that dominates the other layer may take steps to oust it.In the case of Microsoft,the success of Netscape created an unprecedented opportunity for a competitive alternative to Windows.
This view was apparently shared by many at Microsoft.In numerous internal e-mails that were presented at trial,Microsoft executives noted that consumers who bought computers to surf the Internet did not need the Windows operating system.Not only did Netscape's browser run on a variety of operating systems,including Windows and Linux,it had its own applications programming interface(API)enabling developers to write software that runs on top of browser without any other operating system.Moreover,this software could be compatible across platforms,thereby eliminating a key source of network externalities.Microsoft's fear was that millions of consumers who bought low-priced websurfing computers would discover that they did not need windows for surfing the web,e-mail,and instant messaging.In time,they might also find softwarefor text editing,spreadsheet analysis,and other traditional uses of the PC.Through a variety of practices held to be illegal by the courts,Microsoft attempted to drive Netscape from the marker.
